Real Estate and Business Brokers Act

Real Estate and Business Brokers Act

Our client was a successful real estate agent with a well-established business throughout the Greater Toronto Area (GTA). As is common in the fast-paced housing market, a potential buyer lost the bidding war for a house and brought a complaint against our client.

The potential buyer alleged our client was negligent in the bidding process and did not act with the required care and attention when trying to purchase a home. The potential buyer brought a complaint to the Real Estate Council of Ontario (RECO) under the Real Estate and Business Brokers Act (REBBA).

The potential penalties were severe and our client could have lost his ability to practice as a real estate agent in Ontario. The team at KIVLAW Defence Lawyers quickly went to work preparing a defence.

After careful consideration of the evidence, we were able to verify the records of the bidding process and demonstrate that our client had fulfilled all obligations. As a result, our client was acquitted and was able to continue practising as a real estate agent.
